The parties to this agreement have read, understood and agreed to the terms and conditions as follows:
1. The total cost of stud services shall be either the pick puppy of our choice or a stud service fee in the amount of $_________. Payment will be expected at the time the puppies are whelped, unless we have communicated our intent to choose a puppy in lieu of payment. Payment will only be required if at least two puppies are whelped alive and survive 48 hours. This constitutes a litter.
2. The owner of the stud guarantees that the stud is potent, and that a mating was achieved on the above listed date (s).
3. The owner of the bitch certifies that the bitch has not been bred to any other male dog during this heat cycle, nor will they permit her to do so during this heat cycle.
4. The owner of the stud will sign a properly documented litter registration application provided by the breeder of this litter. It is the responsibility of the owner of the bitch to notify the stud owner of the pertinent facts about the whelping. If the bitch is bred to another male dog in violation of the conditions listed above in #3, no litter registration application will be signed and the AKC shall be notified that the litter is not eligible for registration.
5. All puppies shall be given proper care.
6. No puppies from this mating are to be offered for sale to or through any pet shop, grooming parlor, humane organization, or any other kennel.
7. Donway Kennels can and will assist in marketing this litter to potential buyers for an additional fee.
8. The owner of the bitch agrees to pay any and all veterinary expenses incurred in connection with this breeding.
9. Owner of the stud dog reserves the right to withhold signing of the AKC registration application form until all payments have been made regarding stud fee or until pick puppy is in the owner’s or agent’s possession.
Prior to breeding, the owner of the bitch shall provide the owner of the stud the following documents:
· Negative Brucellosis test results within the last 30 days.
· AKC registration certificate for the bitch.
· OFA, CERF certificates for the bitch, if applicable.
· Picture of the bitch.
· Championship certificates if applicable.
· Pedigree of the bitch.
The owner of the bitch will be responsible for providing their chosen food for the dog while it is in our care.
If the bitch is to be shipped to us for breeding, the owner of the bitch will be responsible for any and all transportation costs.
Any requests for changes in the contract’s terms after breeding/whelping is at the owner’s/agent’s option only.
